Hawai`i Revised Statutes Chapter 198 (“Conservation Easements”)

Most states have now enacted implementing legislation for conservation easement transactions. Hawai`i’s law relating to conservation easements is codified in Chapter 198 of the Hawai`i Revised Statutes (“HRS”). (Chapter 198 is part of HRS Title 12, entitled “Conservation and Resources.”)

Chapter 198 includes six sections discussing the following topics: definitions, the nature of conservation easements, who can “hold” or accept an easement, recordation requirements, enforcement and interpretation of an easement’s terms.

Beware that statutes are subject to amendment, and that the information here may be dated.
